In order to ensure the legitimate rights and interests of the buyers and sellers of houses, Party A and Party B voluntarily reach the following agreement on the purchase and sale of houses and warehouses:
Article 1 Through negotiation between Party A and Party B, Party A's husband and wife voluntarily sell a house (building area of square meters) and a storage room (building area of square meters) located in the downtown 1 building unit to Party B ... property ownership certificate number. Article 4 When Party B pays RMB 1 10,000 Yuan to Party A, Party A shall hand over the original house ownership certificate and related documents to Party B for safekeeping. After the land certificate is issued, Party A must cooperate with Party B for safekeeping. In the future, Party A must actively cooperate with Party B to handle the above-mentioned house ownership transfer formalities in the real estate department and hand over the new property right certificate to Party B. Once the ownership of the above-mentioned house is transferred, the property right and use right of the house will be owned by Party B, and Party A no longer has any rights such as property right and use right.
Article 5 Party B shall enjoy and undertake the rights and obligations related to the house from the date of handling the real estate license, such as demolition, and Party A shall enjoy and undertake the rights and obligations arising from the house before this date.
Article 6 Party B shall bear the transaction transfer fees of the above-mentioned residence and storage room. ..
Article 7 Liability for breach of contract:
(1) If Party B fails to pay the above-mentioned house and storage room to Party A within the specified time, Party A shall pay liquidated damages to 50 yuan on a daily basis.
(II) If Party A fails to vacate the house and hand over the real estate license to Party B within the specified time after receiving the house purchase payment from Party B, it must vacate the house and hand over the real estate license to Party B, and pay the liquidated damages of 50 yuan on a daily basis.
(3) If Party A fails to assist Party B in handling the house transfer formalities within a reasonable time from the date when Party B requests Party A's assistance, Party A shall not only cooperate with Party B to go out in time, but also pay liquidated damages to 50 yuan on a daily basis.
(4) After the signing of the house purchase and sales agreement, if Party A fails to sell the above-mentioned house and storage room in breach of contract, Party A shall not only return the house purchase money collected by Party B within the time specified by Party B, but also pay Party B a penalty of RMB 50,000; If Party B has paid but terminated the house purchase, Party A will only return RMB to Party B; If either party fails to pay the house price, no matter which party breaches the contract, the breaching party shall pay the other party a penalty of RMB 10,000 only.
Article 8 When Party A delivers the house to Party B, it shall keep the house intact, and settle all expenses such as water, electricity, heating and property before this.
