Organ donation is voluntary and uncompensated, so no subsidies are given. The local Red Cross in the place where the organ is donated is registered. District cities and counties (cities and districts) shall report the registration to the provincial Red Cross within three days. Local Red Cross societies may entrust medical institutions with the registration, and the medical institutions shall report the registration to the entrusted Red Cross society within three days. A natural person who has reached the age of eighteen and has full capacity for civil behavior may donate a living organ, and there shall be written proof of consent to donation before donation. The donation of living organs by the donor shall not jeopardize his or her life. A natural person willing to donate organs after death shall have written proof of consent to donation. If there is only a verbal expression of consent to donation, the following conditions shall be met: (1) There shall be a written certificate from his or her spouse as well as from two physicians. (b) If there is no spouse, there shall be a written certificate from the parents or adult children and two physicians. (c) If there is no spouse, parent or adult child, there are two other close relatives and a written certificate from two physicians. (D) Without any close relatives, the workplace or place of residence of the residential (village) committees, nursing homes and other organizations, as well as a written certificate of two physicians.

Article 7 of the Regulations on Human Organ Transplantation stipulates that human organ donation shall follow the principles of voluntariness and gratuitousness. Citizens enjoy the right to donate or not to donate their human organs; any organization or individual shall not force, deceive or induce others to donate human organs.

Human Organ Transplantation Regulations, Article 11 of the medical institutions engaged in human organ transplantation, shall, in accordance with the "Regulations on the Administration of Medical Institutions," the provisions of the local provincial, autonomous regions, municipalities directly under the Central People's Government, competent departments of the People's Government of the health department for human organ transplantation diagnostic and therapeutic subject registration. A medical institution engaging in human organ transplantation shall have the following conditions: (1) a licensed physician and other medical personnel appropriate for engaging in human organ transplantation; (2) equipment and facilities needed to meet the needs of human organ transplantation; (3) a committee on the clinical application of human organ transplantation technology and ethics composed of experts in medicine, jurisprudence, ethics, etc., and the number of medical experts engaging in human organ transplantation shall not exceed the number of members of the committee. Medical experts engaged in human organ transplantation in the committee not more than 1/4 of the number of members; (d) have a sound quality control of human organ transplantation and other management systems.
