Legal basis: "Chinese People's *** and State Food Safety Law" Article 126

(c) food, food additives production and operation of the purchase of goods (C) food, food additives manufacturers and operators do not check the license and relevant documents, or not establish and comply with the provisions of the purchase inspection records, factory inspection records and sales records system;
(D) food production and operation enterprises have not developed food safety accident disposal program;
(E) tableware, drinking utensils and containers holding food for direct entry, not washed, disinfected or cleaning and disinfecting unqualified prior to use, or Food service facilities and equipment are not regularly maintained, cleaned and calibrated according to regulations;
(vi) Food production operators arrange for people who have not obtained health certificates or who suffer from diseases that hinder food safety as stipulated by the State Council's administrative department of health to work in contact with direct-entry food;
(vii) Food operators fail to sell food in accordance with the requirements of the regulations;
(viii) Health food manufacturers do not follow the provisions of the food safety supervision and management department for the record, or not according to the filing of product formulations, production processes and other technical requirements of the organization of production;
(ix) infant formula food manufacturers do not food raw materials, food additives, product formulas, labels, etc. to the food safety supervision and management department for the record;
(j) special food manufacturers do not follow the requirements of the Establishment of production quality management system and effective operation, or not regularly submit self-inspection reports;
(k) food production and operation of food safety conditions are not regularly inspected and evaluated, or changes in production and operation conditions, not dealt with in accordance with the provisions of;
(l) schools, child care institutions, nursing homes, construction sites and other centralized dining units do not fulfill the provisions of food safety management Responsibility;
(xiii) food production enterprises, food service providers did not develop and implement the production and operation process control requirements.
Tableware, drinking utensils centralized disinfection service units in violation of the provisions of this Law, the use of water, detergents, disinfectants, or factory tableware, drinking utensils are not in accordance with the provisions of the inspection and accompanied by proof of disinfection, or not in accordance with the provisions of the independent packaging labeled with the relevant content of the people's government at or above the county level by the health administrative department in accordance with the provisions of the preceding paragraph shall be punished.
Food-related products producers are not in accordance with the provisions of the production of food-related products for testing, by the people's governments at or above the county level of food safety supervision and management departments shall be punished in accordance with the provisions of the first paragraph.
Sellers of edible agricultural products in violation of the provisions of Article 65 of this Law, by the people's governments at or above the county level, food safety supervision and management departments shall be punished in accordance with the provisions of the first paragraph.
