Guangxi Zhuang Autonomous Region’s Measures for Implementing the Tendering and Bidding Law of the People’s Republic of China

Article 1: In order to implement the "Tendering and Bidding Law of the People's Republic of China" and in combination with the actual conditions of this autonomous region, these measures are formulated. Article 2 These Measures shall apply to bidding activities within the administrative region of this autonomous region. Article 3 The development and reform administrative departments of the people's governments at or above the county level are responsible for the guidance and coordination of tendering and bidding within their respective administrative regions.

Relevant administrative supervision departments of people's governments at or above the county level shall supervise bidding activities in accordance with the division of responsibilities stipulated by the State Council and the people's governments of autonomous regions, and investigate and deal with illegal activities in bidding activities in accordance with the law. Article 4: Any unit or individual has the right to report illegal acts in bidding activities to the relevant administrative supervision departments. Article 5 Engineering construction projects are infrastructure projects and public utility projects related to social public interests and public security, projects using state-owned capital investment, national financing projects, or projects using funds from international organizations or foreign governments. , including the survey, design, construction, supervision of the project and the procurement of important equipment and materials related to the project construction. If one of the following standards is met, bidding must be conducted:

(1) Estimation of individual construction contracts The price is more than RMB 2 million;

(2) For the purchase of important equipment, materials and other goods, the estimated price of a single contract is more than RMB 1 million;

(3) For the procurement of survey, design, supervision and other services, the estimated price of a single contract is more than RMB 500,000;

(4) The estimated price of a single contract is lower than those in items (1), (2), and (3) Standards specified in the project, but the total investment amount of the project is more than 30 million yuan.

For other engineering construction projects other than those specified in the preceding paragraph, whether to invite bidding or which bidding method to choose shall be decided by the project legal person. Article 6 Infrastructure projects related to public interests and public safety include:

(1) Coal, oil, natural gas, electricity, new energy and other energy projects;

(2) Transportation projects such as railways, highways, pipelines, water transportation, aviation and other transportation industries;

(3) Postal and telecommunications projects such as postal services, telecommunications hubs, communications, and information networks;

(4) Flood control, irrigation, drainage, water diversion (supply), tidal flat management, soil and water conservation, water conservancy projects and other water conservancy projects;

(5) Roads, bridges, culverts, tunnels, slope protection, Urban facilities projects such as subway and light rail transportation, sewage discharge and treatment, garbage disposal, underground pipelines, public parking lots;

(6) Ecological environment protection projects;

( 7) Other infrastructure projects. Article 7 Public utility projects related to public interests and public safety include:

(1) Municipal projects such as water supply, power supply, gas supply, heating, gas supply, gardens, greening, street lighting, etc. Projects;

(2) Science and technology, education, and cultural projects;

(3) Sports and tourism projects;

(4) Health and social welfare projects;

(5) Commercial housing, including affordable housing projects;

(6) Other public utility projects. Article 8 Investment projects using state-owned funds include:

(1) Projects using fiscal budget funds at all levels;

(2) Using various government-specific special construction projects that are included in financial management Fund projects;

(3) Projects that use the own funds of state-owned enterprises and institutions, and where state-owned asset investors actually have control;

(4) Investments that use state-owned funds Other items. Article 9 State financing projects include:

(1) Projects using funds raised by the state’s issuance of bonds;

(2) Projects using funds raised by the state’s external loans or guarantees;

(3) Projects using national policy loans;

(4) Projects financed by state-authorized investment entities;

(5) State-chartered financing project.

Article 10 Projects using funds from international organizations or foreign governments include:

(1) Projects using loan funds from international organizations such as the World Bank and Asian Development Bank;

(2) Projects using funds from international organizations such as the World Bank and the Asian Development Bank; Projects using loan funds from foreign governments and their institutions;

(3) Projects using aid funds from international organizations or foreign governments. Article 11 Among the projects that require bidding according to the first paragraph of Article 5 of these Measures, if the project approval procedures need to be completed in accordance with relevant national regulations and one of the following circumstances occurs, bidding may not be conducted upon approval:

(1) It involves national security, state secrets or emergency and disaster relief and is not suitable for bidding;

(2) Using poverty alleviation funds to implement work-relief requires the use of migrant workers;

(3) The survey and design of construction projects adopt specific patents or proprietary technologies, or have special requirements for architectural artistic modeling; (4) The number of contractors, suppliers or service providers is less than 3 companies cannot form effective competition;

(5) Other circumstances that are not suitable for bidding as stipulated in laws and regulations.

If national key projects determined by the development and reform administrative department of the State Council are not subject to bidding, they shall be subject to approval by the development and reform administrative department of the State Council; if local key projects determined by the people's government of the autonomous region are not subject to bidding, they shall be subject to approval. Approved by the People's Government of the Autonomous Region.

If a construction project that is entirely invested with state-owned funds or has a controlling or dominant position and requires approval is not subject to bidding, it shall be approved by the project approval department; however, if the project approval department only approves the project, the project approval department shall approve the project.
