Chapter I General

Resource allocation efficiency, optimize the competitive market environment, to protect the legitimate rights and interests of production and installation enterprises and protective equipment units, safeguard and supervise the effective implementation of administrative management of the competent departments of the people's air defense to improve the quality of products and services of protective equipment, according to the "People's Republic of China and the State Administrative Licensing Law," "People's Republic of China and the People's Republic of China and the People's Air Defense Law," and other relevant laws and regulations, to formulate the present approach.

Chapter II Permit Conditions
Article VIII of the application for the production and installation of protective equipment for human air defense engineering license qualification of enterprises should have the following conditions:

2, production, process, quality control, installation and other technical departments should have a full-time college degree or above, with construction or mechanical engineering or intermediate technical title, to obtain the second level or above, the human protection engineer license certificate.
3, the technical staff should have nationally recognized qualifications, including more than 2 engineers specializing in architectural engineering or mechanical engineering, more than 1 engineer specializing in electrical engineering, more than 10 welders, more than 8 machining, more than 5 locksmiths, more than 2 electricians, more than 2 lifting equipment, flaw detectors and other special equipment operators.

(C) site

(D) equipment

Chapter III License Application and Processing
Article IX Enterprises applying for licensing qualifications to the state department in charge of human defense, shall submit the following materials, and is responsible for its authenticity:

(b) copy of the original industrial and commercial business license, a copy of the original or the name of the enterprise industrial and commercial pre-approval of the original document, copy ;

(d) the general technical director and production, process, quality control, installation and other technical departments responsible for the person in charge of the qualifications and the list of technicians;
(e) technicians labor contracts, pension insurance and technical titles, copies of certificates of fitness to practice as a human defense protection engineer.
Article X. The applicant enterprise may itself or entrust an agent to submit an application for a license, the license application can be submitted by mail, electronic data interchange, e-mail and other means.
Article XI of the national department in charge of human defense accepts applications for licensing qualifications, in accordance with the following procedures:
(a) the application materials are incomplete or do not meet the requirements, within 15 working days to inform the enterprise needs to make corrections to all the contents;
(b) the application materials are complete and meet the requirements or in accordance with the requirements of all the corrections since the receipt of the application materials or all the corrected application materials is the date of receipt of the application materials or all the corrected application materials. All corrective application materials from the date of acceptance and inform the applicant enterprise;
(c) enterprise application materials in the acceptance of five working days after the Chinese people's air defense network to be publicized, the publicity period of 10 working days. Article 15 The time required for on-site examination, expert evaluation, and solicitation of opinions from relevant parties in the process of preliminary examination by the competent department of human defense at the provincial level and the examination by the competent department of human defense at the national level shall not be counted as part of the period of examination stipulated in these Measures.

"People's air defense engineering protective equipment production and installation of administrative licensing qualification certificate" is valid from the date of the state department in charge of people's air defense to make a decision on the license, as of the date of the start to the first 1 of the same date after 3 years.
Chapter IV Change and Extension of License Qualification
Article 19 Enterprises in the validity of the license qualification in one of the following circumstances, shall apply for a change:
(a) change of production address;
(b) change of production varieties;
(c) change of legal representative of the enterprise;
(d) change of the enterprise name.
(viii) change the name of the enterprise.
Article 20 of the national human defense authorities received the license qualification change application materials submitted by the enterprise, within 15 working days of the audit qualified for licensing qualification change procedures. Article 21 The expiration of the license qualification, to continue to engage in the production and installation of protective equipment for human defense projects, and in the validity of the license qualification meets the following conditions, you can apply for an extension:

Article 23 The application for extension of licensed qualifications shall be submitted three months before the expiration of the validity of the license application materials. If the application for extension is not submitted after the expiration date, a new application shall be made to receive the license qualification.

Chapter V Supervision and Management
Article 24 The competent state departments in charge of supervision and management of the national production and installation of protective equipment for human defense projects, the main responsibilities are:

Chapter VI Legal Liability

Article 35 For one of the following circumstances of the production and installation of licensed enterprises, the state department in charge of human defense has the right to make the suspension, revocation or withdrawal of enterprise licensing qualifications:
(1) providing false materials to apply for licensing qualifications;
(2) the transfer, fraudulent, sale, lease, loan or use of forged licensing qualifications;

(iv) allow other enterprises to rely on the production or licensing sales;
(v) jerry-built or counterfeiting;
(vi) serious quality problems;
(vii) beyond the scope of the license to produce and install;

(X) other aspects of the violation of the provisions of this approach.
Article 36 The competent state department of human defense shall make a public announcement on the China People's Air Defense Network within 15 working days of making a decision to suspend, revoke or revoke the license qualification of the enterprise.
Chapter VII Supplementary Provisions
Article 37 These Measures shall be interpreted by the State Office of People's Air Defense.
Article 38 These Measures shall come into force on the date of promulgation, and the Provisions on the Management of Enterprises Designated for the Production of Protective Equipment for Human Defense Projects (State People's Defense [2009] No. 325) shall be repealed.
