Canadian design patent application process?

1. Application documents: application (including description), photographs or drawings;

Method of filing: paper form or online through the official website of the Canadian Intellectual Property Office (CIPO);

If you have already filed an application for the registration of the same design in China, you must file the application in Canada within six months of the date of filing of the application in China;

If you do not have a domicile or establishment in Canada The other designs shall be registered before the original application is registered, but the filing date of the earlier application may be retained.

2. If the application documents meet the formal requirements, an application certificate will be issued.

3. Preliminary examination will be conducted to ensure that the specifications, pictures or photographs are clear and unambiguous.

4. The examiner conducts a search to ensure that there are no similar designs that have been registered, disclosed or for which an application for registration is pending.

5. When the examiner agrees to the registration, a certificate of registration will be issued. The applicant may apply to the Canadian Intellectual Property Office for a deferral of registration, which may be deferred for up to six months from the date of filing the application.

6. If the examiner issues a final examination report rejecting the application for registration, the applicant may request the Appeal Board to review the decision.
