Measures for the administration of express delivery market

Chapter I General Provisions Article 1 In order to strengthen the management of the express delivery market, safeguard national security and public safety, protect the legitimate rights and interests of users and promote the healthy development of the express delivery industry, these Measures are formulated in accordance with the Postal Law of People's Republic of China (PRC), the Detailed Rules for the Implementation of the Postal Law of People's Republic of China (PRC) and the relevant provisions of the state. Article 2 These Measures shall be observed when engaging in express delivery business activities. Article 3 The term "express delivery" as mentioned in these Measures refers to the delivery service of receiving, mailing, distributing, transporting and delivering letters, parcels and other articles with names and addresses and other articles that do not need to be stored, and delivering them to the recipient or designated place within the promised time limit and signing for them. Article 4 The management of express delivery market shall follow the principles of openness, fairness and justice, and promote the unification, openness, competition and order of express delivery market to meet the needs of economic and social development.

Postal monopoly is protected by law. Enterprises engaged in express delivery business activities (hereinafter referred to as express delivery enterprises) shall operate according to law, be honest and trustworthy, and compete fairly to provide users with fast, accurate, safe and convenient express delivery services. Article 5 Express delivery associations shall strengthen industry self-discipline, provide information and training services for express delivery enterprises, promote the healthy development of express delivery services and improve the overall level. Article 6 Freedom and privacy of communication shall be protected by law. Except that public security organs, state security organs and procuratorial organs check communications according to the procedures prescribed by law for the needs of national security or the investigation of criminal offences, no organization or individual may infringe upon others' freedom and secrets of communication for any reason. Article 7 The national postal administration department is responsible for the supervision and management of the national express delivery market.

Postal administrations of all provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as provincial postal administrations) shall be responsible for the supervision and administration of the express delivery market within their respective administrative areas. Article 8 The transportation activities of express delivery enterprises shall abide by the relevant transportation management regulations and accept the supervision and management of the competent department of transportation. Chapter II Express Service Article 9 Express delivery enterprises shall abide by the commitment of public service and meet the postal industry standards for express delivery services. Article 10 Express delivery enterprises shall publicize service commitments such as service types, service prices, business hours and delivery time limits. Article 11 A courier company shall specify the rights and obligations of both the courier company and the users in written form, and the terms of its format contract shall be fair, reasonable, accurate and comprehensive, and shall be filed with the provincial postal administration department. Thirteenth express delivery enterprises shall establish an emergency mechanism in accordance with the relevant provisions of the state. In case of major service interruption, the express delivery enterprise shall report to the provincial postal administration department in a timely manner in accordance with relevant regulations. In the process of accident handling, the courier company shall record and save all the information related to the accident. Relevant information and written records shall be kept for at least 1 year.

Express delivery enterprises stop express delivery business activities due to reasons such as suspension of business, conversion of production and bankruptcy. , should be timely and properly handle the express mail, and report to the provincial postal management department. Fourteenth express delivery enterprises should strengthen the vocational skills training for express delivery employees. Express salesmen should meet the national professional standards. Fifteenth express delivery enterprises shall not implement the following acts:

(a) in violation of the provisions of the state, the acceptance and delivery of prohibited items, or not in accordance with the provisions of the acceptance and delivery of restricted items;

(2) colluding with each other to manipulate the market price and harming the legitimate rights and interests of other express delivery enterprises or users;

(three) using other people's names, trademarks and corporate logos to disrupt market order;

(four) illegal detention of user express mail;

(five) illegal disclosure of user information known in the process of express delivery service;

(six) other acts prohibited by laws and regulations. Sixteenth express employees shall not carry out the following acts:

(1) Opening, concealing, destroying, detaining, reselling or stealing express mail without permission;

(two) illegal disclosure of user information in the process of engaging in express delivery service;

(3) Other acts prohibited by laws and regulations. Chapter III Safety of Express Delivery Article 17 No organization or individual may use the express delivery network to engage in activities that endanger national security, social public interests or the legitimate rights and interests of others. It is forbidden to deliver the following items:

(1) Articles prohibited from circulation or delivery by laws and regulations;

(two) all kinds of publications, promotional materials, printed matter, etc. , endangering national security and social and political stability, and the content is obscene;

(3) Weapons, ammunition, narcotic drugs, biochemical products, infectious articles and explosive, flammable, corrosive, radioactive, toxic and other dangerous articles;

(4) Articles harmful to public health;

(5) Various currencies in circulation;

(6) Other articles prohibited by the state. Eighteenth express delivery enterprises should establish and strictly implement the acceptance inspection system. For express mail other than letters delivered by users, express delivery enterprises shall inspect the contents on the spot and package them face to face in accordance with relevant state regulations. If the user refuses the inspection, it will not be accepted and sent.

In the process of receiving and sending, express delivery enterprises shall report to the relevant departments in a timely manner when they find articles prohibited by the state.
