Article 1 In order to strengthen the management of city appearance and environmental sanitation, safeguard citizens' personal health and safety, and maintain social public order, these Provisions are formulated in accordance with the provisions of relevant state laws and regulations and in combination with the actual situation of this Municipality.
Article 2 All units and individuals in the urban area of this Municipality shall abide by these Provisions.
Article 3 This Municipality implements the principle of strict control, strict management and combination of prohibition and restriction on raising dogs.
Article 4 The administrative department of city appearance and environmental sanitation of Hangzhou is the competent department of dog management (hereinafter referred to as the competent department of dogs), which is responsible for examining and approving the issuance of licenses for raising, breeding, selling and treating dogs, and handling illegal dog raising and killing rabies and wild dogs jointly with relevant departments.
The public security department is responsible for the preliminary examination of the feeding of strong dogs and large dogs, and handling public security incidents in dog management.
The agricultural department is responsible for the supply of veterinary rabies vaccine, canine epidemic prevention and quarantine, issuance of canine immunization certificates, monitoring of rabies and other canine epidemic situations, and supervision of canine clinics.
The health department is responsible for the supply and vaccination of rabies vaccine and the diagnosis, treatment and monitoring of rabies patients.
The administrative department for industry and commerce is responsible for the management of dog business activities.
Article 5 All organs, organizations, military units, enterprises, institutions, residents' committees and villagers' committees shall carry out publicity and education among cadres, workers, residents, villagers and students, consciously abide by these provisions, and cooperate with relevant departments to do a good job in restricting dog raising.
Any unit or individual has the right to report illegal dog-raising behavior to the competent department of dogs.
Article 6 Urban areas are key restricted dog-raising areas (hereinafter referred to as key restricted dog-raising areas), and urban areas and rural areas are general restricted dog-raising areas (hereinafter referred to as general restricted dog-raising areas).
The specific division of key restricted support areas and general restricted support areas shall be determined by the Municipal People's Government.
Seventh strictly implement the dog license system. Without permission, no unit or individual may raise a dog.
Article 8 It is forbidden to raise strong dogs and large dogs in key restricted areas, and it is forbidden to engage in dog breeding and sales activities.
If it is really necessary for key security units or scientific research units to raise dogs due to the needs of guards and scientific research, they must rely on the certification materials of the superior competent department of the unit, and report to the competent department of dogs for approval after examination and approval by the local public security police station and the district city appearance and environmental sanitation department.
Citizens with permanent residence, single room and civil capacity in this city need to raise small ornamental dogs in key restricted areas, and need to raise dogs in general restricted areas. It must be approved by the local neighborhood office (township government) and the district city appearance and environmental sanitation department with the supporting materials of the neighborhood (village) committee, and reported to the competent department of dog raising for approval.
Overseas personnel living in this city who need to raise small ornamental dogs shall apply to the competent department of dogs for approval. Dogs brought into this city from abroad must comply with the provisions of the Law of People's Republic of China (PRC) on Entry and Exit Animal and Plant Quarantine.
The breeds and specifications of small ornamental dogs allowed to be kept shall be determined and published by the competent department of dogs in conjunction with relevant departments.
Approved individual dog owners are only allowed to keep one dog.
Article 9 The competent department of dogs shall make a decision on whether to raise a dog within 15 days from the date of receiving the application report for raising a dog.
To meet the conditions of quasi-support, the applicant who is issued with a "dog-only purchase certificate" shall, after purchasing a dog according to the regulations, take the dog to the competent department of dogs for registration, registration and inspection within the prescribed time limit with a valid "dog immunization certificate". The competent department of dogs shall issue a dog breeding license and a dog breeding license within 7 days. Do not meet the conditions, give a reply and explain the reasons.
Dogs raised before the implementation of these regulations must go through the registration and inspection procedures in accordance with the provisions of the preceding paragraph within 1 month from the date of implementation of these regulations. Failing to go through the formalities of registration and registration inspection within the time limit shall be dealt with as illegal dog raising.
Dog license is registered every year 1 time.
Tenth units and individuals approved to raise dogs must pay registration fees and registration inspection fees.
The registration fee for keeping small ornamental dogs in key restricted areas is 5000 yuan, and the annual registration and inspection fee is 1 000 yuan. If the registration is made within 1 month from the date of implementation of these provisions, the registration fee will be reduced by 1 ten thousand yuan.
The registration fee for feeding strong dogs and large dogs in key security units is 2,000 yuan each, and the annual registration and inspection fee is 500 yuan. Registered within 1 month from the date of implementation of these Provisions, 500 yuan shall be deducted.
In general, individuals in restricted areas keep small ornamental dogs, and the registration fee is 3000 yuan each. After that, register the inspection fee 500 yuan every year; The registration fee for each domestic dog is 1 1,000 yuan, and the annual registration and inspection fee is 200 yuan. Registered within 1 month from the date of implementation of these Provisions, 500 yuan shall be deducted.
Medical and scientific research units that have been approved to raise experimental dogs are exempt from registration fees and registration inspection fees.
Eleventh units and individuals allowed to raise dogs must comply with the following matters:
(a) according to the notice or written notice of the competent department of dogs, carrying the number plate and dogs to the designated place for inspection and immunization on schedule;
(two) in the neck of the quasi-dog, the dog tag made by the competent department of dogs is hung;
(three) small ornamental dogs must be led by adults within the time allowed to go out. Large dogs must be kept in cages (chained) and not allowed to go out;
(4) Dogs are not allowed to enter markets, shops, restaurants, parks, public green spaces, schools, hospitals, exhibition halls, theaters, stadiums, playgrounds, stations, airports and other public places;
(five) dogs are not allowed to take public transport (except small taxis and human tricycles);
(6) The time allowed to take small ornamental dogs out of the house is 19: 00 to 6: 00 the next day. If the dog excretes feces outdoors, the dog owner shall immediately remove it;
(seven) raising a dog shall not interfere with the normal life of others;
(eight) if the dog is slaughtered, died or missing, it shall go through the cancellation procedures with the competent department of dogs and properly handle it in accordance with the relevant provisions;
(9) Dogs shall not be kept without permission.
Twelfth engaged in dog breeding, sales and establishment of dog clinics, must be approved by the competent department of dogs, can apply to the administrative department for Industry and commerce for a business license. The competent department of dogs shall, jointly with the relevant departments, issue a dog license, a dog sales license and a dog diagnosis and treatment license.
Thirteenth dogs for sale must have valid quarantine and immunization certificates for rabies and other diseases.
Dogs imported from other places must have valid local quarantine and immunization certificates, and can only be sold after the municipal agricultural department has approved the renewal of the Dog Immunity Certificate.
Fourteenth sellers shall not sell dogs to units and individuals in this city without a "dog certificate".
Fifteenth key restricted areas shall not set up a dog farm.
Dog farms approved by the competent department of dogs in general restricted areas in conjunction with relevant departments shall meet the following conditions:
(a) more than 0/000 meters away from the drinking water source/kloc, and more than 500 meters away from the residential area;
(two) the site structure is firm, and the height of the external wall is more than 3 meters;
(three) there are facilities for washing, disinfection and harmless treatment of sewage and dirt;
(four) equipped with a certain number of veterinary personnel with the title of assistant veterinarian or above.
Sixteenth dog clinics must be far away from public places and residential areas, with certain venues, veterinarians with veterinary titles or above, licenses and necessary diagnosis and treatment facilities.
Article 17 If a dog injures people or causes diseases, the dog owner shall send the injured person to the health and epidemic prevention department for diagnosis and treatment, bear all medical expenses and compensate for the losses according to law. The competent dog department shall kill or confiscate his dog, revoke his dog-raising license, and impose a fine of more than 2,000 yuan but less than 5,000 yuan on the dog owner.
Eighteenth dogs without approval shall be confiscated or killed by the competent department of dogs, and a fine of more than 5000 yuan 10000 yuan shall be imposed on the dog-raising unit, and a fine of more than 3000 yuan and less than 5000 yuan shall be imposed on the dog-raising individual.
Nineteenth one of the following acts, by the competent department of dogs withheld dogs, dog owners impose a fine of more than 200 yuan +0000 yuan; If the circumstances are serious, the dog shall be confiscated and the dog-raising license shall be revoked.
(1) Bringing dogs into public places or taking public transport;

(4) Failing to inject rabies vaccine for dogs on schedule;
(5) Failing to apply for inspection and registration on schedule, or raising dogs without authorization;
(6) Failing to go through the cancellation procedures as required;
(seven) in the key restricted areas, the dog owners failed to clear the outdoor excrement of dogs in time.
Article 20 Anyone who, in violation of the provisions of this Ordinance, engages in dog breeding, sales and diagnosis and treatment activities shall be investigated and dealt with by the municipal competent department of dogs in conjunction with relevant departments, all illegal gains and dogs shall be confiscated, the business license and quasi-raising certificate shall be revoked, the responsible unit shall be fined between/kloc-0 and 50,000 yuan, and the responsible person shall be fined between 3,000 yuan and 5,000 yuan.
Twenty-first refuse or hinder the dog management law enforcement personnel to perform official duties, shall be punished in accordance with the "Regulations of the people's Republic of China on administrative penalties for public security"; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.
Twenty-second abandoned, lost and confiscated dogs shall be handled by the municipal competent department of dogs.
Article 23 If a party refuses to accept the administrative decision made in accordance with these Provisions, it may apply for reconsideration or bring a lawsuit in a people's court in accordance with the Regulations on Administrative Reconsideration and the Administrative Procedure Law of the People's Republic of China.
If it fails to apply for reconsideration, bring a suit in a people's court or perform the punishment decision within the time limit, the organ that made the punishment decision shall apply to the people's court for compulsory execution.
Twenty-fourth dog management department staff dereliction of duty, abuse of power, corruption, given administrative sanctions by their units or the competent department at a higher level; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.
Twenty-fifth collection of registration fees, registration fees, fines and fines in accordance with the provisions of the municipal finance.
Twenty-sixth problems in the specific application of these Provisions shall be interpreted by the municipal administrative department of city appearance and environmental sanitation.
Twenty-seventh military, armed police and public security departments official military dogs, police dogs and dogs kept in the zoo management, according to the relevant provisions.
