Regulations of Fushun Municipality on Promoting the Development of Private Economy

Article 1 In order to protect the legitimate rights and interests of private economic organizations, strictly protect the personal safety and property safety of operators of private economic organizations in accordance with the law, promote the healthy, sustainable and innovative development of the private economy, and optimize the development environment of the private economy, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 The term "private economic organizations" as mentioned in these Regulations refers to domestic-funded enterprises as legal persons, unincorporated enterprises, individual industrial and commercial households and other economic organizations established or engaged in investment and operation in this Municipality according to law. Article 3 To promote the development of private economy, we should adhere to the basic principles of government guidance, market dominance, safeguarding rights and interests, and standardizing according to law, and encourage, support and guide the development of private economy. Article 4 The people's governments of cities and counties (districts) shall incorporate the promotion of private economy into the overall plan of national economic and social development, and establish a public service and guarantee system for the development of private economy. Fifth city and county (District) people's governments shall establish a coordination mechanism to promote the development of private economy according to the actual situation. The competent department of industry and information technology is the administrative department in charge of promoting the development of private economy, making overall plans, coordinating, guiding and serving the development of private economy, and doing the following work jointly with relevant departments:

(a) to organize the publicity and implementation of national, provincial and municipal laws, regulations, rules and policies on the development of private economy;

(two) to study the development trend of private economy and formulate specific measures to promote the development of private economy;

(three) strict management and use of special funds for the development of private economy according to law;

(four) to implement the incentives and preferential policies that private economic organizations should enjoy;

(five) regularly listen to the opinions and suggestions of private economic organizations and help private economic organizations solve difficulties and problems;

(six) regularly publish information on the development of private economy, preferential policies and other information. Sixth city and county (District) people's governments shall designate specialized agencies to implement the agency system for key projects of private economic development and provide follow-up services.

City and county (District) people's governments shall establish a public service platform for private economy to provide professional services such as information, technology, management, talents, market, financing and law for private economic organizations.

The people's governments of cities and counties (districts) provide legal services such as legal consultation, legal publicity and people's mediation for private economic organizations free of charge by relying on public legal service entity platform, hotline platform and network platform. Article 7 Trade associations and chambers of commerce shall play a role in serving and regulating the private economy. City, county (District) people's government and its relevant departments shall encourage and support industry associations and chambers of commerce to carry out the following activities:

(1) Organizing consultation and training, information exchange, exhibition investment promotion, market development, domestic and international economic and technological exchanges and cooperation;

(two) to participate in industry access qualification examination, professional qualification certification, registration, scientific and technological achievements appraisal, product quality certification and other matters, and regularly carry out the selection and commendation of outstanding private economic organizations and individuals;

(three) to carry out industry surveys, industry statistics, industry information release and other work according to law;

(four) establish and improve the industry self-discipline mechanism, formulate and organize the implementation of self-discipline regulations;

(five) put forward legislative opinions and suggestions, and participate in the formulation and revision of industry plans, policies, standards and norms;

(six) to reflect the requirements and suggestions of members to the relevant administrative departments, and safeguard the legitimate rights and interests of members according to law;

(seven) to apply for anti-dumping, countervailing, anti-monopoly and safeguard measures to the government and its relevant departments according to law and assist in the investigation; Organizing, guiding and coordinating members' response to anti-dumping, countervailing, anti-monopoly and safeguard measures;

(eight) to mediate all kinds of civil and commercial disputes related to members;

(nine) to perform other duties authorized by laws and regulations, entrusted by the government and stipulated in the articles of association of the trade association. Eighth private economic organizations can enter all industries and fields that are not prohibited by laws and regulations on an equal footing. Market access conditions and preferential support policies should be open and transparent, and no discriminatory conditions or disguised discriminatory conditions should be set for private economic organizations.

Support private capital to enter infrastructure, public utilities, financial services and social undertakings and other related fields. Article 9 Encourage private economic organizations to participate in the reform of mixed ownership of state-owned enterprises, and support private capital investors to participate in the restructuring and reorganization of state-owned enterprises or the capital increase and share expansion of state-controlled listed companies and enterprise management through various means such as capital contribution, equity acquisition, subscription of convertible bonds and equity replacement. Tenth city and county (District) people's government in the formulation and implementation of the overall land use planning and annual land use plan, private economic investors enjoy equal treatment. The municipal and county (District) people's governments shall give support to the new construction land planning indicators for the land used by private economic organizations that conform to the national industrial policy and the direction of industrial structure adjustment and reach the prescribed investment intensity.

A certain proportion of land special indicators should be arranged for new land every year to support private small and medium-sized enterprises' entrepreneurial projects. If the land should be used for compensation, the transfer period can be appropriately shortened or supplied by lease.

Economic and technological development zones, high-tech development zones, industrial parks and other parks should arrange a certain proportion of land for the development of private small and micro enterprises, focus on the construction of standard factories, and provide production and business premises for private small and micro enterprises.

Encourage private enterprises to carry out research and development, pilot verification and trial production, and the relevant departments of the municipal and county (District) governments shall provide necessary guidance and services.
