The establishment, cancellation and scale adjustment of residents' committees shall be proposed by the grassroots people's governments or sub-district offices and approved by the people's governments of cities, districts and counties without districts. Article 5 The tasks of a residents committee are:
(a) to publicize the Constitution, laws, regulations and national policies, safeguard the legitimate rights and interests of residents, and educate residents to fulfill their obligations according to law and take good care of public property;
(two) to implement the decisions and resolutions of the residents' meeting;
(three) to establish and manage the public affairs and public welfare undertakings of the residents in this residential area, develop the production and life service industry for the convenience and benefit of the people, and carry out various forms of community service activities;
(4) Carry out activities to build socialist spiritual civilization, educate residents to establish a new fashion of changing customs, respecting the old and loving the young, helping the disabled and the weak, helping the poor and helping the needy, and uniting and helping each other, and guide residents to establish a healthy, civilized and noble lifestyle;
(five) to mediate civil disputes and promote family harmony and neighborhood unity;
(six) to assist the relevant departments to do a good job in the comprehensive management of social security and maintain social order, production order and living order;
(seven) to assist the people's government to do a good job in youth education, reeducation through labor, family planning, public health, special care and relief;
(eight) to reflect the opinions, demands and suggestions of residents to the people's government or street offices. Article 6 A residents' committee consists of a chairman, vice-chairmen and five to nine members. The number of members shall be determined by the people's governments of cities, cities (prefectures) and counties not divided into districts according to the size of the residents' committees.
In areas where many ethnic groups live in concentrated communities, there should be members of ethnic groups with a small number in the residents' committees. Article 7 The residents' committee shall set up committees for people's mediation, public security, civil affairs, culture, education, health and economic management as required. Members of residents' committees may concurrently serve as members of subordinate committees. A residents' committee with a small number of residents may not set up a subordinate committee, and the members of the residents' committee shall be responsible for the relevant work. Article 8 The residents' committees shall be responsible for the management of production and living service units that facilitate the people and benefit the people, and no department, unit or individual may collect, transfer or occupy them. The newly-established production and life service industry for the convenience and benefit of the residents' committees will be granted 1 year income tax reduction and exemption in accordance with the provisions on tax reduction and exemption for township enterprises. If it is still difficult to pay taxes after the expiration of the period, the income tax will be reduced or exempted for 1 to 2 years upon examination and approval by the tax authorities. Where the placement of disabled people and unemployed youth meet the standards set by the state, they will enjoy relief treatment. Article 10 The production and living service units established by the residents' committee shall pay management fees to the residents' committee at a rate not higher than 10% of the total profit distributed by enterprises at the end of the year. The management fees charged by residents' committees are mainly used to develop production and living services that benefit the people, set up public welfare undertakings in residential areas, increase living allowances for members of residents' committees and improve office conditions. Other departments and units shall not charge management fees repeatedly to the production and living service units established by the residents' committees. Article 11 The chairman, vice-chairmen and members of a residents' committee shall be elected by all residents who have the right to vote or representatives from each household. According to the residents' opinions, two or three representatives may be elected by each residents' group. The term of office of the residents' committee is three years, and members may be re-elected. The election committee of the residents' committee is composed of representatives recommended by the residents' group. Candidates for members of the residents' committee shall not participate in the election committee of the residents' committee.
Measures and specific procedures for the election of residents' committees shall be formulated by the provincial people's government. Article 13 When a member of a residents' committee becomes vacant for some reason, the residents' committee shall nominate a candidate, convene a residents' meeting, conduct a by-election according to the election procedure, and report it to the sub-district office for the record. Fourteenth residents' committees shall adopt the principle that the minority is subordinate to the majority in deciding matters, and major matters shall be submitted to the residents' meeting for discussion and decision. Article 15 Members of a residents' committee shall abide by the Constitution, laws, regulations and state policies, have a democratic style of work, be honest and be devoted to serving residents.
