People's governments at all levels should attach importance to scientific research and technological development in the prevention and treatment of occupational diseases, encourage the popularization and application of new technologies, new equipment and new processes to protect workers' health, and restrict and gradually eliminate production technologies and processes that are seriously harmful to occupational diseases. Fifth health administrative departments at or above the county level shall be responsible for the supervision and management of occupational disease prevention and control within their respective administrative areas.
The relevant administrative departments of planning, construction, labor security, economic management, etc. shall, according to their respective duties, cooperate with the health administrative departments to do a good job in the prevention and control of occupational diseases. Article 6 Trade unions at all levels shall supervise the prevention and control of occupational diseases by the masses according to law, put forward opinions and suggestions, and safeguard the legitimate rights and interests of workers. Article 7 Laborers shall enjoy the following occupational health rights:
(1) Receiving occupational health knowledge training;
(2) Access to prevention and treatment of occupational diseases;
(three) to report and accuse violations of these regulations;
(4) Have the right to refuse to work when the concentration or intensity of occupational hazard factors in the workplace exceeds the national health standards without taking control measures and unnecessary individual protective measures;
(5) Other rights stipulated by laws and regulations.
Laborers should abide by the occupational health system in the process of labor, enhance the awareness of occupational hazard protection, and strictly implement the occupational health operation procedures. Chapter II Prevention Article 8 The employing unit shall establish an occupational health management system, formulate occupational health operation rules, implement the occupational health responsibility system, and set up corresponding management institutions or full-time (part-time) personnel to undertake the prevention and control of occupational diseases. Article 9 The employing unit shall adopt advanced technology or take effective control measures to improve working conditions and ensure that the concentration or intensity of occupational hazards in the workplace meets the national health standards. Article 10 New construction, reconstruction, expansion, technical transformation and technology introduction projects involving hazardous operations (hereinafter referred to as construction projects) shall meet the national health standards and requirements, and their occupational health protection facilities must be designed, constructed and put into production and use at the same time as the main project.
When examining and approving construction projects involving hazardous operations, the construction unit must submit a pre-evaluation report on occupational hazards at the same time; The design and completion of a construction project must be accepted by the health administrative department for occupational health, and the control effect of occupational hazards should be evaluated. Eleventh hazardous workplaces must be equipped with necessary occupational health protection facilities.
In workplaces prone to acute occupational hazards, warning signs should be set up, equipped with effective emergency protection equipment and relief materials, and emergency rescue organizations should be established. Article 12 The employing unit shall regularly maintain and overhaul the occupational health protection facilities, and regularly test the protection effect to ensure the normal use; Without the approval of the administrative department of health, it shall not be removed or stopped.
The employing unit must provide necessary personal protective equipment that meets the national standards for workers, and guide and supervise their correct use. Article 13 No unit or individual may transfer operations with occupational hazards to units or individuals that do not have occupational health protection conditions. Article 14 When concluding a labor contract with an employee, the employer must truthfully inform the employee of the occupational hazards and their consequences in the course of work. A labor contract must be accompanied by a description of occupational hazards. Article 15 The employing unit shall establish occupational health files in accordance with the relevant provisions of the state and the province, and record the relevant information about the production process and occupational hazards that affect the health of workers. Article 16 The employing unit must organize workers to receive pre-job and regular occupational health knowledge training. Workers must be trained and qualified before they can take up their posts. Chapter III Testing Article 17 The employing unit shall test the occupational hazard factors in the workplace in accordance with the relevant provisions of the state and the province. If the health administrative department at or above the provincial level certifies that it has the detection ability, it shall conduct self-inspection; Do not have the ability to detect, should be entrusted to the provincial health administrative department certification bodies for testing.
Testing institutions and personnel must implement hygiene standards and testing technical specifications, and the determination must be scientific and true, and no fraud is allowed. Article 18 The employing unit shall, in accordance with the relevant provisions of the national and provincial health administrative departments, report the detection results of the concentration or intensity of occupational hazard factors in the workplace to the health administrative departments and relevant administrative departments, and announce them to the employees in a timely manner. Nineteenth health administrative departments at all levels shall, within their jurisdiction, implement quality control over the detection of occupational hazard factors and conduct spot checks. Spot-check the same employer every year in 1 to 2 times.
